Stories From The Front Contest Promotion Official RulesTHE FOLLOWING PROMOTION IS available TO residents OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA ONLY (COLLECTIVELY, THE "ELIGIBILITY ZONE"). DO NOT ENTER THIS PROMOTION IF YOU ARE NOT A LEGAL RESIDENT OF THE ELIGIBILITY ZONE. VOID WHERE PROHIBITED BY LAW. NO PURCHASE NECESSARY TO ENTER OR WIN PRIZE. The Kuma\War Real War Stories Promotion ("Promotion") is sponsored by Kuma, LLC, 100 Park Avenue, 17 th Floor, New York, NY 10017 (referred to in these official rules as “Kuma”). The Promotion is governed by these official rules. By participating in the Promotion, each entrant agrees to these official rules, including all eligibility requirements, and understands that the results of the Promotion are final in all respects. The Promotion is subject to all federal, state and local laws and regulations and is void where prohibited by law. Winners will be determined based on the most compelling 500-word description of factual events involving United States soldiers in combat based on criteria as set forth below. ELIGIBILITY The Promotion is only open to legal residents of the United States who are 18 years of age or older at the time of entry who are active duty or retired United States military personnel or their immediate families (which shall include, parents, spouses, children, siblings, and grandparents). Each entrant must have a valid e-mail address to participate. Employees, officers and directors of Kuma, any participating media outlet, and their respective parents, subsidiaries, consultants, agents and suppliers, (collectively, “Promotion Entities”) as well as their immediate families and persons living in the same household as such individuals, are not eligible to enter or win. Kuma reserves the right to verify the eligibility of all winners. HOW TO ENTER - There are two (2) methods to enter: OR 2. E-mail entry: To enter by e-mail, during the Promotion Period, e-mail an entry with an essay of not more than 500 words to Maximcontest@kumagames.com along with complete contact information, including name, address, age, phone number, and e-mail address. General Conditions of entry : No faxed, mailed (other than e-mail) or telephoned-in entries will be accepted. Entries must be in English. All components of the entry must be entrant's own original creation, executed solely by entrant and based on facts and circumstances that are true and accurate. Entries may not have been published previously, in whole or in part, or have won any other award. Modifying, enhancing, or altering a third party's preexisting work or news report does not qualify as an entrant's original creation. Entries must be in keeping with Kuma's image as a quality provider of online entertainment and may not be offensive, as determined by the judges in their sole discretion. Any entry that contains third-party property or materials or elements not owned by entrant, contains apparently classified information, violates anyone’s privacy, or does not comply with any particular aspect of these official rules may be disqualified. Prizes Except as specifically provided herein, each winner is solely responsible for all expenses and fees, including, without limitation, taxes, insurance, telephone charges, personal expenses, shipping charges or transportation, or any other item related to the prize or this Promotion. Reporting and payment of all applicable taxes, fees, or surcharges, if any, resulting from, acceptance or use of a prize, are the sole responsibility of the winner. If Kuma cannot find a sufficient number of potential winners who are able satisfy all requirements within the timeframe allotted, all prizes may not be awarded. Awarding of prize is contingent upon potential winner successfully passing accuracy and background checks to Kuma’s satisfaction. LIMIT ONE (1) ENTRY PER PERSON . All entries become the exclusive property of Kuma and will not be returned, and each entrant assigns to Kuma all right, title and interest to the entry, including, without limitation, all intellectual property and other proprietary rights without expectation of compensation or acknowledgment. Receipt of entries will not be acknowledged, and proof of submission of an entry will not be deemed proof of receipt. Kuma has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. Kuma is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected entries, which will be disqualified. For the purposes of this Promotion and these official rules, "receipt" of an entry occurs when Kuma’s servers record the entry information upon clicking the "enter" or "submit" button at the bottom of the entry form, or when Kuma’s mail server registers receipt of an e-mailed entry. Any automated computer receipt (such as one confirming delivery of e-mail or a "thanks for entering message") does not constitute proof of actual receipt of an entry by Kuma. In the event of a dispute as to any entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. WINNER SELECTION A. Round One: Eligible entries will be initially judged by a panel chosen by Kuma, in Kuma’s sole discretion. The judges will evaluate each eligible entry based on the following criteria: i) creativity and compelling nature; ii) appropriateness in creating playable simulations; iii) information and insight into current military operations; and iv) unique expression of thought. The judges will select four (4) entries based on these criteria to be named as potential semifinalists. Within seven (7) days after the conclusion of Round One, the potential semifinalists chosen by the judges will be contacted by telephone, e-mail or postal mail, according to the contact information provided by that entrant. If a potential semifinalist cannot be contacted, or does not return the phone call or correspondence within three (3) days following attempted notification, the potential semifinalist may be disqualified and an alternate semifinalist contacted. Potential semifinalists (or a potential semifinalist's parent or legal guardian if the potential Semifinalist is a minor in his state of legal residence) will be required to sign an Affidavit of Eligibility and Publicity Release (collectively, the "Affidavit"). As part of the Affidavit, each potential semifinalist (or his parent or legal guardian) will be required to give his permission for Kuma (and other parties that may be designated by Kuma) to seek one or more investigative reports, which may be from outside sources, on the accuracy of any quotation or other information relating to the entry, the potential semifinalist's identity and character, and identify any security concerns. Failure to give permission may result in disqualification of the potential semifinalist. The Affidavit must be fully completed and returned within seven (7) days following receipt of the Affidavit from Kuma, or the potential semifinalist may be disqualified. B. Round Two: From August 15, 2004 - September 1, 2004 (the "Voting Period"), the four (4) semifinalist entries chosen in Round One for which Affidavits have been received and the entrant’s approved will be posted at http://www.kumawar.com. Members of the public may visit the Promotion Website (http://www.kumawar.com) and vote for their favorite entries from among the eligible semifinalists. Members of the public may each place only ONE vote for their favorite semifinalist entry. NO AUTOMATED VOTES (including, without limitation, votes made using any script, bot, macro, or sweepstakes service) will be accepted. PLEASE NOTE that even if an entry is listed as the winner, THAT ENTRANT IS ONLY THE POTENTIAL WINNER AND HAS NOT YET OFFICIALLY WON A PRIZE. All votes remain subject to verification by the Kuma before a winner will be named. Within seven (7) days after the conclusion of the Voting Period, the potential winners chosen by the public in each category will be contacted as noted above. If a potential winner cannot be contacted, or does not return the phone call or correspondence within three (3) days following attempted notification, that potential winner may be disqualified and an alternate winner contacted. To be awarded the Prize, except where prohibited by law], potential winners must provide additional information, including photos or videos of themselves or participants in the event provide quotes, submit to recorded interviews, obtain, execute and return any additional releases and required forms, including an IRS W-9 form, and provide other help and cooperation necessary in order to for Kuma to verify the facts portrayed in the potential winner's entry and to develop a Kuma\War game mission based on the event described in the potential winners' entry. Potential winners must provide all materials listed above between September 1, 2004 and October 1, 2004. ADDITIONAL Limitations The Promotion Entities and any telephone network or service providers are not responsible for incorrect or inaccurate transcription of entry information or votes of any individual, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any web site or online service or any other error, human or otherwise. INDEMNIFICATION AND LIMITATION OF LIABILITY by accepting a prize, EACH winner agrees to INDEMNIFY, release and hold harmless The Promotion Entities and all their respective officers, directors, employees, representatives and agents from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from that WINNER’S participation in the PROMOTION and the acceptance of any PRize that may be won. The PROMOTION ENTITIES DO not make any warranties, express or implied, as to the condition, fitness or merchantability of any of the prizes. Each Winner agrees to execute any document containing the terms and conditions of these official rules. THE PROMOTION ENTITIES and all their respective officers, directors, employees, representatives and agents DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS to OR the DOWNLOAD of INFORMATION OR MATERIALS CONNECTED WITH THe contest.
